2、:甲乙雙方與 年 月 日簽訂勞動(dòng)合同，為明確有關(guān)甲方的肖像使用中的權(quán)利義務(wù)關(guān)系，經(jīng)雙方友好協(xié)商，達(dá)成如下協(xié)議：Party A and Party B signed a Labor Contract on /m /d, /y, and in order to clarify the rights and obligations related to use of Party As portraits, they reached and entered into the following Agreement upon friendly negotiation:甲方為本協(xié)議的肖像權(quán)人，許可乙方在品

3、牌宣傳過(guò)程中使用甲方肖像。I. Party A is the portrait right owner hereof, and Party B is authorized to use Party As portraits in the process of brand promotion.許可使用期限為： 甲乙雙方勞動(dòng)關(guān)系存續(xù)期間以及雙方勞動(dòng)關(guān)系解除之日起一年。II. The term of license is during existence of the labor relationship between both parties and one years from termina

4、tion of such relationship.許可使用形式包括但不僅限于照片、視頻、美術(shù)作品等；III. The forms licensed include but are not limited to photos, videos, or artworks.許可使用地域范圍為中國(guó)大陸。IV. The geographical scope licensed is Mainland China.五、甲方許可乙方依本協(xié)議約定用途無(wú)償使用甲方姓名、肖像。 V. Party A hereby grants Party B the right to use his name and portra

5、its free of charge for the purposes specified herein.六、在許可使用期間內(nèi)，乙方不得將該肖像用于其他用途或轉(zhuǎn)交第三方使用，除非事先征得甲方書(shū)面同意；VI. During the term of license, Party B shall not use the portraits for other purposes or transfer to a third party before obtaining prior written consent of Party A.七、在甲乙雙方勞動(dòng)關(guān)系存續(xù)期間內(nèi)，甲方不得將上述肖像另外許可第三方使

6、用，除非事先征得乙方的書(shū)面同意，但接受采訪、撰寫(xiě)文章的除外；VII. During the term of the labor relationship between both parties, Party A shall not license the abovementioned portraits to a third party for use before obtaining the prior written consent of Party B, except for being interviewed and writing articles.八、乙方承諾將依照中國(guó)大陸地區(qū)法

7、律使用甲方上述肖像，不損害甲方享有的合法權(quán)益，乙方如有違反本協(xié)議之規(guī)定，將承擔(dān)違約責(zé)任。VIII. Party B promises to use the abovementioned portraits of Party A in accordance with laws of Mainland China without prejudice to the legitimate rights and interests enjoyed by Party A. In case that Party B violates the provisions hereof, it shall be he

8、ld liability for breach of contract.由此給甲方造成損害的，乙方應(yīng)及時(shí)消除影響、賠禮道歉，并賠償因此造成的直接經(jīng)濟(jì)損失。In case of any damage to Party A, Party B shall promptly eliminate the influence, apologize, and compensate for the direct economic losses caused thereby.九、甲乙雙方因與本協(xié)議有關(guān)的任何事項(xiàng)發(fā)生爭(zhēng)議，由雙方友好協(xié)商解決。協(xié)商不成的，任何一方可向甲方所在地人民法院提起訴訟。IX. 9、e of any dispute between both parties arising from any matter related hereto, both parties shall solve such dispute through friendly negotiation. In case that the negotiation fails, either party may file a lawsuit to the Peoples Court of the place where Party A is located.十、本協(xié)議自甲乙雙方簽章之日起生效，一式貳份，甲乙雙方各執(zhí)壹份，具有同等法律效力。X.
