Both parties adhere to releva nt provisi ons of the state and this muni cipality releva nt laws and regulati ons.一、聘用期限Employme nt Period第一條 期限為 年,自 年月日起至年月日止。This con tract will take effective from(date, mon th, year)
4、 to(date, mon th,year).二、工作內(nèi)容及工作地點(diǎn)Work ing Content And Work ing Locati on第二條 甲方根據(jù)工作需要聘用乙方從事 工作。Party A employ Party B to work in area according to the need ofbus in ess.第三條乙方的工作地點(diǎn)為 。Party Bworking place is .第四條乙方應(yīng)按所在崗位和工作內(nèi)容的要求,認(rèn)真履行職責(zé),按時(shí)完成工作任務(wù),遵守甲方依法制定的規(guī)章制度。Party B shall fulfill his working duties ac

Party B should abide by the rules and regulations in Party A.第五條 根據(jù)工作需要,經(jīng)雙方協(xié)商一致,甲方可以調(diào)整乙方的工作崗位、工作地點(diǎn)。If required by the work and with agreement by both parties, Party A can adjust Party Bs job title and work location.三
6、、工作時(shí)間和休息休假Worki ng Hours And Vacati ons第六條根據(jù)乙方工作崗位的實(shí)際情況,確定工作時(shí)間按以下第 種工時(shí)工種制執(zhí)行。Accordi ng to the actual situati on of Party Bs job, opti onof the followi ng would bechose n to be the work ing times schedule.(一)標(biāo)準(zhǔn)工時(shí)工作制:每日工作不超過八小時(shí),且甲方應(yīng)保證乙方每周至少休息一天。Standard working hours: Work no more than eight hours a d
7、ay, and Party A shall ensure at least one off-day each week for Party B.(二)不定時(shí)工作制:甲方在保障乙方身體健康并充分聽取乙方意見的基礎(chǔ)上,應(yīng)采用集中休息、輪休調(diào)休、彈性工作時(shí)間等適當(dāng)方式,確保乙方的休息休假權(quán)利和生產(chǎn)工作任務(wù)完成。Non-fixed worki ng hours: With con siderati on for Party B health con diti on and suggestio ns, Party A would adopt a proper way including concentr
8、ated rest, paid leave, flexible working hours to en sure Party Bs right on rest and vacati ons with completi on of Party Bwork.(三)其他類型的作息時(shí)間: Other types of working hours : 四、勞動(dòng)報(bào)酬P(guān)ayme nt第七條 乙方的薪酬標(biāo)準(zhǔn)為:每月支付乙方工資 元(稅前)。Party Bs sta ndard salary is:RMB per month (before tax).第八條甲方每月日前以銀行劃賬形式支付乙方工資。Party A
9、 would pay Party B before every of the month through bank transfer.第九條甲方依法從乙方工資中代扣代繳乙方應(yīng)向國家繳納的個(gè)人所得稅及法定可代扣代繳的其他費(fèi)用。Party A would withhold Party B due pers onal in come tax and other legally charged fees from Party B salary.五、勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)危害防護(hù)Labor Protect ion. Work ing Con diti ons And Occupati onal Haz
10、ard Protect ion第十條甲方根據(jù)乙方崗位的實(shí)際情況,向乙方提供符合國家規(guī)定標(biāo)準(zhǔn)的勞動(dòng)保護(hù)用品。Accord ing to the actual situatio n of Party B job requireme nt. Party A shall provide labor protection articles qualified for provisions of the state standard.第十一條甲方為乙方提供符合國家安全衛(wèi)生標(biāo)準(zhǔn)的工作場所和完成工作任務(wù)所必須的勞動(dòng)工具。Party A should provide work places qualified
11、for national safety and health sta ndards and tools n ecessary for the job.第十二條甲方根據(jù)國家有關(guān)法律法規(guī),建立健全安全生產(chǎn)制度和職業(yè)危害防護(hù)制度,雙方應(yīng)當(dāng)嚴(yán)格遵守,嚴(yán)禁違章作業(yè),防止事故的發(fā)生,減少職業(yè)危害。Party A shall establish safe producti on system and occupati onal hazards protecti on system accord ing to releva nt state laws and regulati ons. Both partie
12、s shall strictly abide by it to avoid illegal operatio n and preve nt accide nts which may cause occupati onal hazards.第十三條乙方對(duì)甲方管理人員違章指揮、強(qiáng)令冒險(xiǎn)作業(yè),有權(quán)拒絕執(zhí)行;對(duì)危害生命安全和身體健康的勞動(dòng)條件,有權(quán)提出批評(píng)、檢舉和控告。Party B is entitled to decline any violated order or forcing of risk duties. Party B has the right to criticize, impea
13、ch and charge to any labor conditions which may endan ger his/her life safety and body health.六、勞動(dòng)紀(jì)律Labor Discipli ne第十四條 遵守國家法律、法規(guī)及甲方指定的各項(xiàng)規(guī)章制度,遵守職業(yè)道德,維護(hù)甲方的榮譽(yù)和利益,按時(shí)保質(zhì)保量地完成工作任務(wù)是乙方應(yīng)盡的義務(wù)。Party B shall comply with n ati on al laws, regulatio ns and rules poin ted by Part A, abide by professional ethics,
14、 protect the honors and interests of Party A and ensure his/her completed staff work.第十五條乙方應(yīng)遵守甲方根據(jù)生產(chǎn)經(jīng)營需要依法指定的規(guī)章制度和勞動(dòng)紀(jì)律。如乙方違反 甲方指定的規(guī)章制度和勞動(dòng)紀(jì)律,甲方有權(quán)根據(jù)規(guī)章制度進(jìn)行處理。Party B should abide by the specified rules, regulations and labor discipline specified by Party A accordi ng to the n eeds of bus in ess operati

Party A has the right to proceed with rules and regulations if there are violations to the rules, regulations and labor discipli ne from Party B.第十六條甲方的各類規(guī)章制度,及甲乙雙方簽訂的有關(guān)協(xié)議均為本合同的有效補(bǔ)充,與本合同具有同等的法律效力。All rules and regulatio ns, in clud ing agreeme nts sig ned by Party A and Party B aside from this
16、con tract, have the equal legal effect as this con tract.七、合同的履行、變更、解除、終止、續(xù)訂Impleme nt, Chan ge, Remove, End and Renew Of The Con tract第十七條 聘用合同期滿前一個(gè)月,經(jīng)雙方協(xié)商同意,可以續(xù)訂聘用合同。Agreed by both parties, Party A and Party B can sig n a renew con tract a month before the expiry date of the con tract.第十八條下列情形之一本合
17、同可終止Follow ing situatio ns may cause con tract term in ati on(一)本合同期滿The con tract expires(二)雙方就解除本合同協(xié)商達(dá)成一致Both parties agree on term in ati on of the con tract(三)簽訂合同時(shí)的客觀條件發(fā)生變化,無法繼續(xù)履行合同The objective con diti ons cha nges and the con tract cannot con ti nue to perform(四)乙方由于健康原因不能繼續(xù)履行本合同義務(wù)的Due to Pa
18、rty Bs health problems, he/she cannot continue to perform the obligations of this con tract(五)其他情況:Other con diti ons:第十九條甲、乙雙方若單方面解除本合同,可提前三十天以書面形式告知對(duì)方即可。To termi nate this con tract from a sin gle party, he/she n eeds to inform the other party in writte n form 30 days in adva nee.第二十條本合同終止、解除后,乙方應(yīng)
19、在30天內(nèi)將有關(guān)事項(xiàng)及因履行本協(xié)議從甲方處取得的資料文件等向甲方移交完畢,并附書面說明;移交完畢后公司將在下一工資發(fā)放日結(jié)算并發(fā)放剩余報(bào)酬;如未履行相關(guān)交接工作并給甲方造成損失,應(yīng)予賠償。Once remove or expirati on of the con tract, Party B shall return releva nt matters including documents and information obtained from Party A within 30 days with written statement. After duty transfer, the
20、company will settle the rest payment on the next payroll day. Any losses caused by in capable of complete tran sfer would be asked for compe nsati on toParty A.八、特別約定及其它事項(xiàng)Other Matters第二十一條 乙方變更通信地址或手機(jī)、固定電話等其它聯(lián)系方式時(shí),應(yīng)當(dāng)于變更發(fā)生之日 起十日內(nèi)書面通知甲方。If Party B changes communication address or other contact inform
21、ation, such as the cell number and fixed telephone, he/she shall give a written notice to Party A within ten days from the changes.第二十二條 本合同未盡事宜,雙方可以協(xié)商簽訂補(bǔ)充協(xié)議,補(bǔ)充協(xié)議與本合同具有同等效力。For items not mentioned in this contract, both parties can negotiate to sign a supplementary agreement. Supplementary agreement
22、 enjoys same legal effect as this contract.第二十三條 本合同自甲、乙雙方蓋章或簽字之日起生效。本合同一式兩份,甲乙雙方各執(zhí)一份。This contract is effective by signatures of both parties. This contract is made in duplicate and each party holds one counterpart.第二十四條 甲方的員工手冊和規(guī)章制度為本合同附件。Handbook and other rules and regulations legally stipulated
23、 by Party A are annexes of this contract.甲方(蓋章) :甲方(蓋章) :Party A (stamp):Party B (signature):法定代表人或主要負(fù)責(zé)人 (簽字蓋章)補(bǔ)充協(xié)議The notice of termination must be submitted in writing. 有關(guān)終止合同的通知必須以書面形式提交。A revocation of the appointment of Mr / Ms GF for development ladder can be carried out by the shareholders me
24、eting for important reasons at any time. Important reasons particularly gross breach of duty or incompetence are to be considered for proper management. Possibly resulting compensation claims by the development manager of this Agreement shall not be affected by the revocation. 提交重要原因并經(jīng)股東會(huì)通過,可以隨時(shí)廢除該合
25、同。重要原因應(yīng)包括失職或不能勝任該職位。研 發(fā)中心總經(jīng)理若提出補(bǔ)償索賠要求,將不受到合同廢除影響。HR:合同的解除及補(bǔ)償中國是有相關(guān)法律規(guī)定的,如出現(xiàn)以上情況依據(jù)中國法律規(guī)定執(zhí)行。不建議合同中約定The con tractual relati on ship ends without no tice at the end of the month in which his head of development 65/66/67. Years of age (depending on age development manager).合同將在研發(fā)中心總經(jīng)理 年滿 65/66/67 歲(依據(jù)研發(fā)
26、中心總經(jīng)理年紀(jì)而定)的當(dāng)月末自動(dòng)失效。HR:因Manfred年齡達(dá)到中國法律規(guī)定退休年齡,因此不存在退休等問題??赏ㄟ^合同約定期限或相關(guān)解除條款等方式解除合同 不建議合同中約定If the head of development in accordance with a medical certificate permanently no longer able to fulfill its duties under this contract, the employment contract expires at the end of the month in which a doctor
27、has reached that conclusion. The permanent incapacity is indisputably assumed if a disease-related disability uninterrupted nine months or a longer period. In the event of termination of employment due to permanent disability, the development manager is entitled to a severance payment of three times
28、 the basic monthly salary within the meaning of 若研發(fā)總經(jīng)理提交醫(yī)療證明,證明其本人永久性不能履行此合同下其職責(zé),勞動(dòng)合同將在醫(yī)生的證 明下在當(dāng)月月末失效。關(guān)于永久喪失工作能力定義為本人在持續(xù)的九個(gè)月或更長的時(shí)間里受到疾病 相關(guān)的殘疾,研發(fā)中心總經(jīng)理將有權(quán)獲得每月基本工資( 4第一條所定的)三倍的 遣散費(fèi) 。HR因病不能繼續(xù)履行合同的情況中國有相關(guān)法律規(guī)定,以上條款高于中國相關(guān)標(biāo)準(zhǔn) 請領(lǐng)導(dǎo)確認(rèn),是否同意 4 para 1 fEnd the employment relationship by the death of development ma
29、nager, has his spouse (in) / partner (in), Mr / Ms xxxx yyyyyy 4 para 1 f若此雇傭合同因被雇人死亡而失效,他的配偶, Mr/Ms XX 有權(quán)從其死亡的當(dāng)月和之后三個(gè)月獲得 相當(dāng)于其每月基本工資( 4第一條所定的)的金額作為 賠償金 。除此之外,其繼承人也符合條件。HR:非因公死亡是否享有補(bǔ)償金,請領(lǐng)導(dǎo)確認(rèn),是否同意并且此條款非聘用相關(guān)內(nèi)容,屬于繼承關(guān)系。 不建議寫入合約中The Parties will conduct a review of remuneration for the period from 1.1.201

31、司對(duì)車輛使 用的政策來安排。HR:我司行政部門會(huì)依據(jù)公司規(guī)定進(jìn)行安排,但目前并沒有車輛直接提供。請領(lǐng)導(dǎo)確認(rèn),是否同意The Company will make the development manager for an apartment in the upscale standard. 公司將為受雇人提供一處以高檔標(biāo)準(zhǔn)要求的 住所 。HR:我司行政部門會(huì)依據(jù)公司規(guī)定進(jìn)行安排,請領(lǐng)導(dǎo)確認(rèn),是否同意The Head of Developme nt has in the case of medically diag no sed sick leave are en titled to con ti nued remuneration in case of sickness for a period of six months.
