nform.2．ThecompetentauthoritiesoftheMemberStatesshallwithinonemonthinformeachotherofanywithdrawalofEECtypeapproval,andofthereasonsforsuchmeasures.3．IftheMemberStatewhichhasgrantedEECtypeapprovaldisputesthefailuretoconformnotifiedtoit,theMemberStatesconcernedshallendeavourtosettlethedispute.TheCommissionshallbekeptinformedandshall,wherenecessary,holdappropriateconsultationsforthepurposeofreachingasettlement.共16頁第5頁1970L0388——2004年5月1日—006.001B第二條各成員國依據(jù)第一條對聲響報警裝置批準(zhǔn)型式進行了認(rèn)證之后，各成員國應(yīng)給相應(yīng)的制造商或其授權(quán)代理商發(fā)予放歐共體零部件EEC型式認(rèn)證標(biāo)記，該標(biāo)記應(yīng)按照與附件I第1.4項所示式樣相符。各成員國應(yīng)采取適當(dāng)措施，防止按照第一條之要求取得型式認(rèn)證后的聲響報警裝置使用容易和其他裝置發(fā)生混淆的標(biāo)記，在使用時與其它裝置產(chǎn)生混淆。第三條1．如果聲響報警裝置標(biāo)附有EEC歐共體型式認(rèn)證標(biāo)記，則各成員國不得以與因為這些裝置結(jié)構(gòu)或者操作方法工作方式為理由的原因，禁止其上市銷售。2．然而，如果對標(biāo)附有歐共體EEC認(rèn)證標(biāo)記的聲響報警裝置，如果其在設(shè)計上與認(rèn)證過的原型不符相一致，本規(guī)定不應(yīng)阻止成員國可以采取上述措施。該成員國應(yīng)即刻將其采取的措施通知其它成員國和委員會，詳細(xì)并說明相關(guān)依據(jù)有關(guān)理由。同時應(yīng)執(zhí)行第五條的規(guī)定也應(yīng)適用。倘若不遵守滿足附件I第項中規(guī)定的上下限，則應(yīng)認(rèn)為屬于在第一款含義范圍內(nèi)無法與第一小段中提到的與認(rèn)證過的原型相不一致符的情況。第四條各成員國的主管當(dāng)局發(fā)證機關(guān)應(yīng)在一個月內(nèi)將其批準(zhǔn)或者拒絕批準(zhǔn)認(rèn)證的各類型聲響報警裝置的型式認(rèn)證證書副本發(fā)送至其它成員國的主管當(dāng)局發(fā)證機關(guān)。第五條1．如果批準(zhǔn)準(zhǔn)予歐共體EEC零部件型式認(rèn)證的成員國發(fā)現(xiàn)很多大量帶有歐共體零部件型式認(rèn)證標(biāo)記的聲響報警裝置與認(rèn)證過的相同認(rèn)證標(biāo)記的型式不符，則該成員國可以采取必要措施保證產(chǎn)品生產(chǎn)模型與得到認(rèn)證的型式相符。該成員國的主管當(dāng)局發(fā)證機關(guān)應(yīng)該告知建議其它成員國的主管當(dāng)局發(fā)證機關(guān)所采取的相應(yīng)措施，如果有必要直至如果這些聲響報警裝置始終不能與經(jīng)過認(rèn)證的型式相符，可以撤銷其歐共體該EEC型式認(rèn)證。上述成員國的主管當(dāng)局發(fā)證機關(guān)，在如果接到發(fā)生此類情況的其他成員國主管當(dāng)局發(fā)證機關(guān)的類似不一致的通知后，也應(yīng)采取同樣的措施。2．各成員國的主管當(dāng)局發(fā)證機關(guān)應(yīng)在撤銷歐共體零部件EEC型式認(rèn)證之后一個月之內(nèi)通知其它成員國主管當(dāng)局發(fā)證機關(guān)，同時告知采取此類措施的理由。3．批準(zhǔn)EEC準(zhǔn)予歐共體型式認(rèn)證的成員國，如果對被通告通知它的與認(rèn)證不符的情況存有爭議，有關(guān)各成員國應(yīng)盡力解決爭端。有相關(guān)情況應(yīng)通知委員會，在必要時，委員會應(yīng)主持進行磋商，以達(dá)到解決爭端的目的。共16頁第6頁1970L0388—N—01.05.2004—006.001BArticle6AlldecisionstakenpursuanttotherulesadoptedinimplementationofthisDirectiveandrefusingorwithdrawingapprovalforanaudiblewarningdeviceorprohibitingitsmarketingoruseshallstateindetailthereasonsonwhichtheyarebased.Adecisionshallbenotifiedtothepartyconcerned,whoshallatthesametimebeinformedoftheremediesavailabletohimunderthelawsinforceintheMemberStatesandofthetimelimitsallowedfortheexerciseofsuchremedies.Article7NoMemberStatemayrefusetograntEECtypeapprovalornationaltypeapprovalofavehicleongroundsrelatingtoitsaudiblewarningdeviceifthatdevicebearstheEECapprovalmarkandifitisfittedinaccordancewiththerequirementslaiddowninitem2ofAnnexI.▼A1Article7aNoMemberStatemayrefuseorprohibitthesaleorregistration,entryintoserviceoruseofavehicleongroundsrelatingtoitsaudiblewarningdeviceifthatdevicebearstheEECapprovalmarkandifitisfittedinaccordancewiththerequirementslaiddowninitem2ofAnnexI.▼B

Article8ForthepurposesofthisDirective,‘vehicle’meansanymotorvehicleintendedforuseontheroad,withorwithoutbodywork,havingatleastfourwheelsandamaximumdesignspeedexceeding25km/h,withtheexceptionofvehicleswhichrunonrails,agriculturaltractorsandmachinery,andpublicworksvehicles.Article9TheamendmentsnecessaryforadjustingtherequirementsofAnnexesIandIIsoastotakeaccountoftechnicalprogressshallbeadoptedinaccordancewiththeprocedurelaiddowninArticle13oftheCouncilDirectiveof6February1970ontheapproximationofthelawsoftheMemberStatesrelatingtothetypeapprovalofmotorvehiclesandtheirtrailers.Article101．MemberStatesshallputintoforcetheprovisionscontainingtherequirementsneededinordertocomplywiththisDirectivewithineighteenmonthsofitsnotificationandshallforthwithinformtheCommissionthereof.2．MemberStatesshallensurethatthetextsofthemainprovisionsofnationallawwhichtheyadoptinthefieldcoveredbythisDirectivearecommunicatedtotheCommission.Article11ThisDirectiveisaddressedtotheMemberStates.共16頁第7頁1970L0388——2004年5月1日—006.001B第六條應(yīng)詳細(xì)說明以下作法依據(jù)的理由：依據(jù)本指令實施過程中采用的法規(guī)規(guī)則而做出的所有決定；聲響報警裝置認(rèn)證的拒絕或者撤消；聲響報警裝置的禁止銷售或者使用。應(yīng)將上述決定通知有關(guān)方面相關(guān)方，同時應(yīng)通知后者按照成員國現(xiàn)行正在實施中的法律其可以采取的補救措施采取的補救措施，以及實施補救措施實施上述補救措施的時間期限。第七條如果聲響報警裝置附著有EEC歐共體零部件型式認(rèn)證標(biāo)記，并且其安裝符合附件I第2項中的規(guī)定要求，則各成員國不得因為以與聲響報警裝置的原因有關(guān)的理由，拒絕批準(zhǔn)給相關(guān)車輛的發(fā)予歐共體EEC型式認(rèn)證或國家型式認(rèn)證。▼A1第七a條如果聲響報警裝置附著有EEC歐共體零部件型式認(rèn)證標(biāo)記，并且其安裝符合附件I第2項中的規(guī)定要求，則各成員國不得以與因為聲響報警裝置有關(guān)的理由的原因，拒絕或者禁止相關(guān)車輛的銷售、注冊、投入運行或使用。▼B

第八條本指令中，“車輛”指的是設(shè)計用于道路行駛、裝有或未裝車體、至少有四個車輪、最大設(shè)計車速超過25公里/小時的所有機動車及其掛車。在鐵路軌道上行駛的車輛、農(nóng)用拖拉機和機械設(shè)備以及公用工程車輛除外。第九條為了考慮到技術(shù)的發(fā)展，有必要調(diào)整附件I和附件II中的要求，應(yīng)按照1970年2月6日委員會指令關(guān)于機動車及其掛車型式認(rèn)證的第十三條中的規(guī)定的程序，采用采納相應(yīng)的校正附件I和附件II的要求所需的修正案。該指令是關(guān)于各成員國機動車及其掛車車型認(rèn)證的近似法律。第十條1．各成員國應(yīng)為了在本指令通告后十八個月內(nèi)遵照，開始執(zhí)行包含滿足本指令所需要的要求的規(guī)定，各成員國應(yīng)實施必需的規(guī)定，并即時將實施相關(guān)情況通知委員會。2．各成員國應(yīng)保證將本指令所涉及領(lǐng)域內(nèi)其所采用的本國法之主要條款原文傳達(dá)給委員會。第十一條本指令通過寄送方式下發(fā)至各成員國。共16頁第8頁1970L0388—N—01.05.2004—006.001BANNEXI1．EECTYPEAPPROVALOFANAUDIBLEWARNINGDEVICE1.1Thewarningdeviceshallemitacontinuoussound.1.2Thewarningdeviceshallhaveacousticcharacteristics(frequencyspectrumofthesound,levelofsoundpressure)andmechanicalcharacteristicssuchthatitcansatisfythefollowingtests,intheorderindicated.1.2.1MeasurementofsoundlevelThewarningdeviceshallbetestedinasufficientlysilentandopenarea(1)(ambientnoiseandwindnoiseatleast10db(A)belowthenoisebeingmeasured)orinananechoicchamber;themicrophoneofthemeasuringinstrumentshallbelocatedinthedirectioninwhichthesubjectivesoundlevelisatamaximumand2mfromthefrontsurfaceofthedevice,themicrophoneandthedevicebeingpositionedataheightof1·20mabovegroundlevel.Themeasurementsshallbemadeonthe‘A’weightingscaleoftheIEC(InternationalElectrotechnicalCommission)standard,bymeansofsound-levelmetersconformingtothetypedescribedinPublications179,1sted.(1965),oftheInternationalElectrotechnicalCommission.Thedeviceshallbesuppliedwithavoltageof6·5,13or26voltsmeasuredattheterminalofthesourceofelectricpower,correspondingrespectivelytoaratedvoltageof6,12or24volts.Theresistanceoftheconnectingleads,includingtheresistanceoftheterminalsandcontacts,mustbe:0.05ohmsfora6voltcircuit0.10ohmsfora12voltcircuit0.20ohmsfora24voltcircuitThedeviceshallberigidlymounted,usingthepartorpartsprovidedbythemanufacturer,onasupportwhosemassisatleasttentimesthatofthedeviceandnotlessthan15kg.Undertheaboveconditions,thesubjectivesoundpressurelevelmustbenotmorethan118dB(A)andnotlessthan105dB(A).Thetimelapsebetweenthemomentofactivationandthemomentatwhichthesoundreachestheminimumlevellaiddowninitemabovemaynotexceed0·2seconds,measuredinanambienttemperatureof20±5oC.Thisprovisionshallapplyinparticulartopneumaticallyorelectro-pneumaticallyoperateddevices.Deviceswhicharepneumaticallyorelectro-pneumaticallyoperatedmust,withthepneumaticcircuitarrangedinaccordancewiththemanufacturer'sspecification,havethesameacousticperformanceasthatrequiredforelectricallyoperatedaudiblewarningdevices.1.2.2EndurancetestsThewarningdevicemustbesuppliedwithoneoftheratedvoltagesspecifiedinitemabove,throughconnectingleadshavingoneoftheresistancesasspecifiedinitemabove,andbeoperated50000times,eachtimeforaperiodofonesecond,followedbyafour-secondbreak.Duringthetest,thedevicemustbeventilatedbyanaircurrenthavingaspeedofapproximately10m/s.Ifthetestiscarriedoutinananechoicchamber,thelattermustbeofsufficientvolmuetoallownormaldispersaloftheheatemittedbythedeviceduringtheendurancetest.(1)Theaforementionedareamaytaketheform,forinstance,ofanopenspaceof50mradiushavingacentralpartofatleast20mradiuswhichispracticallylevel,surfacedwithconcrete,asphaltorsimilarmaterial,andnotcoveredwithpowderysnow,tallgrass,lightsoilorashes.Measurementsshallbecarriedoutinfineweather.Nopersonotherthantheobservertakingthereadingsfromtheapparatusmayremainneartheaudiblewarningdeviceorthemicrophone,asthepresenceofspectatorsnearcitherthedeviceorthemicrophonemayconsiderablyaffectthereadingsfromtheapparatus.Fluctuationsofthepointerwhichappeartobeunrelatedtothecharacteristicsofthegeneralsoundlevelshallbeignoredintakingreadings共16頁第9頁1970L0388——2004年5月1日—006.001B附件I1．聲響報警裝置的歐共體EEC型式認(rèn)證1.1報警裝置應(yīng)能發(fā)出連續(xù)的聲響。1.2報警裝置應(yīng)具有相應(yīng)的聲學(xué)特性（聲音的頻譜，聲壓級）和機械特性，應(yīng)能按照指定的順序滿足下面所規(guī)定的順序的試驗要求。1.2.1聲級的測量報警裝置的試驗應(yīng)在足夠安靜和開闊的場所（1）（環(huán)境噪聲和風(fēng)噪聲至少低于被測聲音10分貝（A））或者在一個消聲室中進行；測量儀的麥克風(fēng)的放置應(yīng)朝著主管主觀聲級最大的方向并且距裝置的前表面2米，麥克風(fēng)和裝置的高度應(yīng)距地面1.20米。測量應(yīng)按照IEC（國際電工委員會）標(biāo)準(zhǔn)的加權(quán)等級‘A’進行，所使用的聲級測量儀應(yīng)符合國際電工委員會第179號出版物第一版（1965）規(guī)定的型號。向額定電壓為6伏、12伏或24伏的裝置提供的電壓在電源接線端的測量值應(yīng)分別為6.5伏，、13伏或26伏，分別對應(yīng)6伏，12伏或24伏的額定電壓。連接線的電阻，包括接線端和觸點的電阻，必須是：對于6伏的電路：0.05歐姆對于12伏的電路：0.10歐姆對于24伏的電路：0.20歐姆應(yīng)當(dāng)利用制造商提供的部件將裝置緊緊固定在支座上，支座的重量至少應(yīng)為裝置的10倍且不少于15公斤。在上述條件下，主觀聲壓級不得高于118分貝（A）且不得低于105分貝（A）。在20±5oC的環(huán)境溫度下測量時，從激活到聲音達(dá)到上面中規(guī)定的最低主觀聲壓級之間的時延不應(yīng)超過0.2秒，本條款專門適用于氣動或電動-氣動裝置。在氣動或電動-氣動裝置的氣動回路按照制造商的說明規(guī)范布置時，該裝置的聲學(xué)特性性能必須與對電動聲響報警裝置的要求相一致。1.2.2耐久試驗必須向報警裝置的供應(yīng)電壓應(yīng)滿足提供中的規(guī)定的的額定電壓之一，連接線的電阻應(yīng)滿足為上面的中規(guī)定的電阻之一，運行50000次，每次持續(xù)一秒鐘，間隔時間為4秒鐘。試驗過程中，應(yīng)使用速度約為10米/秒的氣流向?qū)ρb置通風(fēng)。若試驗在一個消聲室里進行，該消音聲室的容積空間應(yīng)足以消散保證該裝置在耐久試驗過程中散發(fā)出的熱量正常散熱。（1）例如，該場所可以是，一塊半徑為50米的場地，中央至少有半徑為20米的較為平坦的區(qū)域，場地表面為混凝土、瀝青或類似的材料，并且沒有粉末狀雪、高草、輕質(zhì)土壤或灰塵。測量應(yīng)在良好的天氣進行。除了一名從儀器上讀取數(shù)值的觀測人員外，其他人不得在聲響報警裝置或麥克風(fēng)附近停留，因為裝置或麥克風(fēng)附近的旁觀人員可能對儀器的讀數(shù)產(chǎn)生實質(zhì)性影響。讀取數(shù)值時應(yīng)忽略與一般聲級特性無關(guān)的指針震動波動。共16頁第10頁1970L0388—N—01.05.2004—006.0
