1、房屋租賃合同出租方(甲方):Lessor (Party A):承租方(乙方):Lessee (Party B):居間方(丙方):上海德佑房地產(chǎn)經(jīng)紀有限公司Intermediary party (Party C): Shanghai Deovolente Realty Co., Ltd.根據(jù)中華人民共和國合同法、上海市房屋租賃條例等相關(guān)法律法規(guī) 的規(guī)定,甲、乙雙方經(jīng)丙方居間介紹,在平等、自愿、公平和誠信的基礎(chǔ)上,經(jīng) 協(xié)商一致,就乙方承租甲方的房屋事宜,簽訂本合同,以資共同遵守:This Con tract is made by Party C and betwee n both parties

3、he house of Party A:一、出租房屋基本情況:(下稱“該房屋”,實際情況以權(quán)屬證明或相關(guān)法 律文書的記載內(nèi)容為準)I. Usage of the ren ted premises乙方向甲方承諾,租賃該房屋作為(居住辦公生產(chǎn)倉儲其他)使用,并遵守國家和本市有關(guān)于房地產(chǎn)使用和物業(yè)管理的規(guī)定。Party B shall make commitment to Party A that the premises shall be used as ( Residential house Office Produc

Date of delivery and term of leasing3.1甲乙雙方約定,甲方應(yīng)于年 月 日之前向乙方交付該房屋。交付時甲、乙雙方在丙方見證下簽訂本合同之附件二房屋交 接書。3.1 Both parties have agreed that Party A s

Rent, method and time of payme nt4.1甲乙雙方約定,該房屋每月租金為(人民幣

PartyB shall pay the rent before the day in the first mon th of everypayme nt period. In case of payme nt delay, the pen alty shall be collected at the daily rate of

The acco unt of Party A to receive the rent: Acco untname: Opening Bank: Account No.: 4.4以上租金(包含 不包含)甲方出具租賃發(fā)票的費用。4.4 The above rent ( cludesexcludes) the fees on t

13、he leasinginv oices issued by Party A.五、保證金(押金)和其他費用V. Guara ntee deposit (security deposit) and other fees5.1甲乙雙方約定,在(交房簽訂本合同)時,乙方應(yīng)向甲方支付房屋租賃保證金(押金),保證金(押金)為 個月的租金,即(口 人民幣美元 )元(大寫萬_仟一佰拾元整)。甲方收取該保證金(押金)后應(yīng)向乙方出具收款憑證。租賃關(guān)系終止時,甲方收取的房屋租賃保證金(押金)除用 于抵充本合同約定由乙方承擔的費用外,剩余部分無息歸還乙方。5.1 Both parties have agreed th

At the time of the term in ati on of leas ing relation, the guarantee deposit (security deposit) collected by Party A shall be used to offset the fees un dertake n by Party B as agreed in this Con tract and the remai ning porti on shall be returned to Party

16、 B without in terest.5.2租賃期間內(nèi)發(fā)生的水費、電費、煤氣費、電話(通訊)費、電視收視 費等房屋使用費用由乙方承擔;物業(yè)管理費由(甲方乙方)承擔。5.2 The cost aris ing from water, electricity, gas, teleph one call(communication) and TV and so on( 或 etc.) during the leasing period shall be un dertake n by Party B; property man ageme nt fee shall be undertaken b

17、y ( CParty A Party B).六、房屋使用要求和維修責任VI. House use requireme nts and maintenance resp on sibility6.1租賃期間,乙方發(fā)現(xiàn)該房屋及其附屬設(shè)施有損壞或故障時,應(yīng)及時通 知甲方修復(fù);甲方應(yīng)在接到乙方通知后的 日內(nèi)進行維修。逾期不維修的,乙方可代為維修,費用由甲方承擔。6.1 During the leas ing period, if Party B discovers any damage ortrouble with the premises and the accessory facilities,

18、Party B shall timely no tify Party A for repair; Party A shall carry out the repair within day(s) after receiving the notification. In case of delayof repair, Party B may make the repair in place of Party A at the cost of Party A.6.2租賃期間,乙方應(yīng)合理使用并愛護該房屋及其附屬設(shè)施。因乙方使用 不當或不合理使用,致使該房屋及其附屬設(shè)施損壞或發(fā)生故障的,乙 方應(yīng)負責維

19、修。乙方拒不維修的,甲方可代為維修,費用由乙方承擔。6.2 During the leas ing period, Party B shall make reas on able use of thepremises and the accessory facilities. Any damage or troublearis ing from improper use or un reas on able use of the premises and accessory facilities shall be repaired by Party B. In the eve nt that

20、Party B refuses the repair, Party A may carry out the repair in place of Party B at the cost of Party B.6.3租賃期間,甲方應(yīng)保證該房屋及其附屬設(shè)施處于正常的可使用和安全 的狀態(tài)。甲方對該房屋進行檢查、養(yǎng)護,應(yīng)提前 日通知乙方。檢查養(yǎng)護時,乙方應(yīng)予以配合。甲方應(yīng)減少對乙方使用該房屋的影響。6.3 During the leasing period, Party A shall ensure normal availabilityand safe status of the premises

21、and accessory facilities. If Party A intends to carry out in specti on and maintenance on the premises, Party A shall notify Party B days in advanee. During thein spect ion and maintenan ce, Party B shall provide coord in atio n.Party A shall mi ni mize the in flue nce on the use of the premises.6.4

22、乙方需裝修或者增設(shè)附屬設(shè)施和設(shè)備的,應(yīng)事先征得甲方的書面同意,按規(guī)定須向有關(guān)部門報批的,則應(yīng)由(甲方甲方委托乙方)報請有關(guān)部門批準后,方可進行。乙方增設(shè)的附屬設(shè)施和設(shè)備的歸屬及 其維修責任由甲、乙雙方另行書面約定。6.4 In case that Party B intends to decorate the premises or addaccessory facilities and equipme nts, Party B shall obtai n writte n permissi on from Party A in adva nce; if it is required so,(

23、Party AParty B en trusted by Party A) shall submit such behavior to thecompete nt departme nt for approval before the impleme ntatio n. The own ership and maintenance of the accessory facilities and equipme nts added by Party B shall be additi on ally agreed by both parties in written form.七、房屋返還與續(xù)租

House retur n and ren ti ng ren ewal7.1乙方應(yīng)在本合同的租賃期限屆滿之后的 日內(nèi)返還該房屋,未經(jīng)甲方同意逾期返還該房屋的,每逾期一日,乙方應(yīng)以日租金 的%向甲方支付該房屋占用期間的使用費。7.1 Party B shall return the premises within days after theterm in ati on of the leas ing period, and in case of any delay for the return of the premises without permission of Party

25、A, Party B shall pay Party A the use fee of the premises at the daily rate equivale nt to % of daily rent duri ng the occupati on of the premises.7.2乙方如果需要續(xù)租的,應(yīng)在租賃期限屆滿兩個月之前向甲方提出,甲 方同意的,雙方另行簽訂相關(guān)續(xù)租文書。乙方在同等條件下享有優(yōu)先 承租權(quán)。7.2 In case that Party B wants to renew the Con tract, Party B shall raise the ren ew

26、al inten ti on to Party A two mon ths before the term in ati on of the leas ing period, and with the approval of Party A, the ren ewal con tract will be additi on ally sig ned betwee n both parties. Un der the equivale nt con diti on, Party B shall have the priority for obta ining the lease.7.3租賃期限屆

27、滿,甲乙雙方未續(xù)簽租賃合同,乙方繼續(xù)支付租金,甲方 未表示拒絕的,則按法律相關(guān)規(guī)定,雙方之間成立不定期租賃關(guān)系。 在不定期租賃關(guān)系中,甲方有權(quán)提前一個月通知乙方租賃關(guān)系終止。7.3 After the term in ati on of the leas ing period, if no ren ewal con tract is sig ned by both parties and Party B continues pay ing the rent, which is not refused by Party A, the non-fixed-term leasing relation

28、s are established betwee n both parties accordi ng to releva nt laws and regulations. During such non- fixed-term leasing relations, Party A shall have the right to term in ate the leas ing relati ons by no tify ing Party B one (1) month in adva nee.7.4乙方返還該房屋應(yīng)符合正常使用后的狀態(tài)。返還時,應(yīng)經(jīng)甲方驗收認 可,并相互結(jié)清各自應(yīng)當承擔的費用

29、。7.4 The premises returned by Party B shall be consistent with the status after no rmal use of the premises. Upon retur n of the premises, Party B shall in spect the premises before its accepta nee and the releva nt fees for respective parties shall be settled.八、轉(zhuǎn)租與轉(zhuǎn)讓VIII. Sublease and tran sfer8.1除

30、甲方已經(jīng)在本合同中同意乙方轉(zhuǎn)租外,乙方在租賃期限內(nèi),需事先 征得甲方的書面同意,方可將該房屋部分或全部轉(zhuǎn)租給他人。但原始 戶型同一間居住房屋,不得分割轉(zhuǎn)租。8.1 Except that Party A agrees in this Con tract that the premises may be subleased by Party B, Party B shall not sublease part or all of the premises to any other pers on with in the leas ing period, without written permi

31、ssion of Party A. Anyhow one living room in the original household type shall not be separated for subleas ing.8.2在租賃期限內(nèi),甲方如需出售該房屋,應(yīng)提前兩個月通知乙方。乙方 在簽署本合同之時,已確認放棄優(yōu)先購買權(quán)。8.2 During the leas ing period, if Party A wants to sell the premises, Party A shall no tify Party B two (2) mon ths in adva nee. Party

32、 B con firmed the waiver of the preempti on of the premises at the time of sig ning this Con tract.九、解除合同的條件IX. Con diti ons for con tract can celati on9.1甲乙雙方同意在租賃期限內(nèi),有下列情形之一的,本合同終止,雙方 互不承擔責任:9.1 Both parties agree that duri ng the leas ing period, this Con tract shall be term in ated n either part

33、y n eed ing to assu ming any resp on sibility in case of any of the follow ing situati ons;(一) 該房地產(chǎn)占用范圍內(nèi)的土地使用權(quán)依法提前收回的; The use right of the land occupied by the real estate has bee n legally retrieved;(二) 該房地產(chǎn)因社會公共利益被依法征用的;(2) The premises are occupied by means of legal requisiti on due to social an

34、d public in terests;(三) 該房地產(chǎn)因城市建設(shè)需要被依法列入房屋拆遷許可范圍內(nèi)的;(3) This real estate has to be legally put into the dismantling range due to urba n con structi on;(四) 該房屋毀損、滅失或者被鑒定為危險房屋的;(4) The premises are damaged, destroyed or verified as dan gerous house;(五) 甲方已告知乙方該房屋出租前已設(shè)定抵押,現(xiàn)被處分的;(5) Party A has no tified

35、 Party B that the premises have bee n pledged before leas ing and now has bee n disposed;(六) (6) .9.2甲乙雙方同意,有下列情形之一的,一方可書面通知另一方解除本合 同。違反合同的一方,應(yīng)向另一方按月租金的倍支付違約金,給對方造成損失的,支付的違約金不足以抵付損失的,還應(yīng)賠償造成 的損失與違約金的差額部分:9.2 Both parties agree that either party may no tify the other party to can cel this Con tract in

36、 writte n form in case of any of the followi ng situati on, and the party that breaches this Con tract shall pay the other party the liquidated damages equivale nt to time(s) ofthe mon thly rent, and in case that the losses in curred to both parties cannot be offset by the liquidated damages paid by

37、 the breach ing party, the breach ing party shall pay the differe nee betwee n the in curred losses and the liquidated damages;(一) 甲方未按時交付該房屋,經(jīng)乙方催告后 日仍未交付的;(I) Party A fails to hand over the premises on time, and eve n days after exige nt no tice of Party B;(二) 甲方交付的該房屋不符合本合同的約定,致使不能實現(xiàn)租賃目 的的;或甲方交付的房

38、屋存在缺陷,危及乙方安全的;(II) The premises han ded over by Party A do not comply with the agreeme nt in this Con tract, which therefore makes it impossible to realize the leasing purpose; or the premises handed over by Party A have the defects endan geri ng the safety of Party B;(三) 乙方在甲方按時交付該房屋的情形下,未能配合辦理交房手續(xù)

39、,經(jīng)甲方催告后日仍未配合辦理交房手續(xù)的;(III) In spite of the timely handover of the premises by Party A,Party B fails to cooperate to go through the procedures for the handover of the premises days after the exigent notice ofParty A;(四) 乙方未征得甲方書面同意改變該房屋用途,致使該房屋損壞的;(IV) Party B cha nged the use of the premises without

40、writte n permissi on of Party A and therefore in curred the damage of the premises;(五) 因乙方原因造成該房屋主體結(jié)構(gòu)損壞的;(V) The mai n structure of the premises is damaged due to the reas ons of Party B;(六) 乙方擅自轉(zhuǎn)租該房屋或轉(zhuǎn)讓該房屋承租權(quán)的;(VI) Party B subleases the premises or transfers the leasing right of the premises withou

41、t permissi on of Party A;(七) 乙方逾期不支付租金累計超過 月的;(VII) Party fails to pay the rent up to more tha n mon ths;(八) (VIII) .十、違約責任X. Breachi ng liability10.1該房屋交付時存在缺陷的,甲方應(yīng)自交付日起日內(nèi)進行修復(fù),逾期不修復(fù)的,甲方同意減少租金并變更有關(guān)租金條款。10.1 In case of any defect with the premises at the time of handover, Party A shall make the repai

42、r within days after the handover, and if no repair is made even after the stipulated period, Party A agrees to reduce the rent and cha nge the clause related to the rent.10.2因甲方未告知乙方,該房地產(chǎn)出租前已抵押或產(chǎn)權(quán)轉(zhuǎn)移已受到限制, 造成乙方損失的,甲方應(yīng)當負責賠償。10.2 In case that Party A fails to no tify Party B that the premises have bee

43、n pledged or the own ership tran sfer of the premises has bee n restricted, any loss in curred to Party B therefrom shall be paid by Party A.10.3租賃期間,甲方不及時履行本合同約定的維修與養(yǎng)護責任,致使該房屋損壞,造成乙方財產(chǎn)損失或人身傷害的,甲方應(yīng)承擔賠償責任。10.3 During the leas ing period, Party A fails to timely perform the maintenance resp on sibilit

44、y of the premises as agreed in the Con tract, which therefore has in curred the damage of the premises, the n any property loss or pers onal injury in curred upon Party B shall be compe nsated by Party A.10.4租賃期間,非本合同規(guī)定的情況,甲方擅自解除本合同,提前收回該 房屋的,甲方應(yīng)按月租金的 倍向乙方支付違約金。若違約金不足以抵付乙方損失的,甲方還應(yīng)負責賠償。10.4 During th

45、e leas ing period, Party A uni laterally can celled thisCon tract and took back the premises in adva nee in case of the situati ons other tha n those stipulated in the Con tract, Party A shall pay Party B the liquidated damages equivale nt to times ofmon thly ren t. If the liquidated damages cannot

46、compe nsate for the loss in curred upon Party B, Party A shall provide furthercompe nsati on.10.5乙方未征得甲方書面同意或者超出甲方書面同意的范圍和要求裝修 房屋或者增設(shè)附屬設(shè)施和設(shè)備的,甲方可以要求乙方恢復(fù)房屋原 狀賠償損失。10.5 If Party B decorates the premises or adds the accessory facilities or equipme nts without writte n permissi on of Party A or bey ond

47、the scope and requireme nts agreed in writte n permissi on of Party A, Party A may require Party B to recover the premises to the original state, compensate for the loss.10.6租賃期間,非本合同規(guī)定的情況,乙方中途擅自退租的,乙方應(yīng)按月 租金的倍向甲方支付違約金。若違約金不足以抵付甲方損失的,乙方還應(yīng)負責賠償。10.6 During the leasing period, in case of the situation o

48、ther than thosestipulated in the Con tract, Party B stops the ren ti ng, Party B shall pay Party A the liquidated damages equivale nt to time(s)of mon thly ren t. If the rent is not eno ugh to offset the loss in curred upon Party A, Party B shall provide further compe nsati on.卜一、居間條款XI. I ntermedia

49、ry clause三方一致確認,甲、乙雙方是在丙方的居間介紹之下達成本交易的,甲、乙、丙三方簽署本合同,即為丙方居間成功,甲、乙雙方愿意按照約定向丙方支付傭 金。具體約定詳見甲方與丙方,以及乙方與丙方各自簽署的傭金確認書。Three parties unanim ously confirm that Party A and B reach this Con tract un der the in termediary in troducti on of Party C, and the sig nature of this Con tract by three parties means th

50、e success of in termediary service of Party C, for which Party A and B are willi ng to pay Party C the commissi on as agreed. For more details, refer to the commissi on con firmatio n letter sig ned betwee n Party A and C, and between Party B and Party C.十二、定金條款XII. Down payme nt甲乙雙方約定,在簽訂本合同時,乙方支付(

51、人民幣美元.元(大寫萬仟佰拾元整)作為定金, 由乙方直接或通過丙方支付給甲方,或者由丙方根據(jù)甲方的授權(quán)予以保管。Party A and B agree that at the time of sig ning this Con tract, Party B shall pay (dRMB USD ) (Say Only)as the down payment, which shall be paid to Party A directly or via Party C, or Party C may keep the dow n payme nt with the authorizati on

52、 of Party A.若到本合同約定的交房日期甲方未能按時交房的,經(jīng)乙方催告后日仍未交付的,甲方需雙倍返還定金給乙方;若到本合同約定的交房日期乙方未能配合 交房的,經(jīng)甲方催告后日仍未配合辦理交房手續(xù)的,則甲方有權(quán)沒收乙方支付的定金;發(fā)生本條款所述情形時,守約方有權(quán)選擇適用本條款或第9.2款的相關(guān)約定。若甲乙雙方履行完畢交房手續(xù),則該定金作為租金或者租賃保證金(押 金)的一部分進行抵充。In the eve nt that Party A fails to han dover the premises at the date of han dover as agreed in this Con

53、 tract, and eve n days after exige nt no ticeof Party B, then Party A shall pay double the return of the deposit to Party B; in case that Party B fails to cooperate with Party A for the han dli ng proceduresof the han dover by the date of han dover agreed in this Con tract, and eve n days after exig

54、ent notice of Party A, Party A shall have the right to confiscate the down payment paid by Party B; in case of any situation in this Article, the observant party shall have the right under the regulations in this Article or Article 9.2. If both parties han dled the procedures for the han dover of th

55、e premises, the dow n payme nt shall be used to offset the rent or the guara ntee deposit (security deposit) for the rent.十三、其他條款XIII. Others13.1本合同及附件一自甲、乙、丙三方于本合同簽章處簽字或簽章后立即 生效。13.1 This Con tract and its Appe ndix I shall come into effect upon the sig natures or seal stampi ng of Parties A, B and C.13.2本合同空格處填寫文字與鉛
